Terms of Service
Last updated: September 28, 2026
These terms are an agreement between you and Rise SWFL (“Rise,” “RiseSWFL,” “we,” “us”), based in North Fort Myers, Florida. They apply when you use www.riseswfl.com, hvac.riseswfl.com, leads.riseswfl.com, other Rise business sites, or customer landing pages hosted on our platform (the “Services”). By using the Services or buying anything from us, you agree to them. If you don’t agree, please don’t use the Services.
1. What the platform is
RiseSWFL operates marketing, referral, and lead-generation websites that connect people requesting local services with participating, independently owned and operated service providers. We are not a contractor, and we do not perform, supervise, or guarantee any work. Rise also provides websites, lead-handling systems, and growth services to businesses.
2. Service providers
Providers shown or matched through the Services are solely responsible for their own licensing, insurance, permits, pricing, scheduling, and workmanship. Any agreement for services is strictly between you and the provider, and you are never obligated to hire a provider we show or match. A “Featured partner” label means the business pays for placement; it is not an endorsement or a guarantee of quality. Ratings shown from third parties (such as Google) are theirs, not ours. Please verify licensing and insurance before hiring anyone.
3. Estimates and content
Estimate-calculator results and business diagnostics are informational ranges based on typical assumptions and the figures you enter. They are not quotes, bids, offers, or predictions of results, and actual pricing or outcomes may differ materially. Educational content is general information, not professional advice for your situation.
4. Business customers and paid services
If you buy from us on behalf of a business, you confirm you’re authorized to do so. Our paid services are:
- Featured-partner listings — a $99/month subscription for placement in the local-provider list on our consumer sites. Listings go live only after payment and our review.
- Rise growth services — monthly plans with an implementation fee, as described on our business site and in your written proposal or order. If a signed proposal or order conflicts with these terms, the signed document controls for that engagement.
- Lead purchases — per-lead charges for service requests we deliver to you, billed monthly.
You agree to give us accurate business and billing information and keep it current. You are responsible for activity under your account and for keeping any sign-in links we email you private.
5. Payment and billing
- Payments are processed by Stripe. We do not store full card numbers. By subscribing or saving a payment method, you authorize us to charge it for recurring fees and delivered leads until you cancel.
- Prices are in U.S. dollars and exclude applicable taxes, which are added where required. Usage-based costs such as high-volume voice, SMS, advertising spend, or unusual third-party licensing are disclosed and billed separately.
- Subscriptions renew automatically each billing period. Invoices are due on receipt unless your proposal says otherwise.
- If a payment fails, we’ll notify you and retry. We may pause a listing or service while an invoice remains unpaid for more than 14 days.
- We’ll give you at least 30 days’ notice by email before any price change to an existing subscription takes effect; you can cancel before then.
- Please raise billing concerns with us within 60 days of the charge. Contact us before filing a dispute with your bank — we’ll resolve it faster.
6. Cancellation
- Featured-partner listings have no contract. Cancel at any time by emailing us; your listing stays live through the paid period and you won’t be charged again.
- Rise growth-service plans can be cancelled with 30 days’ written notice, after any minimum term in your proposal or order (for example, the Founding Partner Program’s 90-day initial engagement). Fees for the notice period remain due.
- Lead buyers can stop receiving leads at any time; leads already delivered are billed on the next invoice.
We may suspend or end a paid service if you materially breach these terms, including non-payment or misuse of leads. See section 14.
7. Refunds and credits
- Listings we don’t approve: if we decline or remove your featured listing, we cancel the subscription and refund the most recent charge in full.
- Listings you cancel: monthly fees are not refunded for partial periods, but you keep your placement through the end of the period you paid for.
- Implementation fees are refundable in full until work begins. Once implementation starts, they cover work performed and are non-refundable.
- Monthly service fees are not refunded for partial months. If we fail to deliver a service described in your proposal, tell us and we’ll fix it or credit the affected period.
- Leads: you may request a credit within 7 days of delivery for a lead that is invalid — for example a disconnected number or bad email, a duplicate we delivered to you in the previous 30 days, a request outside the service area or service type you agreed to buy, or a request that isn’t genuine. A lead that simply doesn’t convert is not invalid. Approved credits reduce your next invoice or are refunded if you’ve stopped buying.
- Billing errors: duplicate or incorrect charges are always refunded.
Approved refunds are returned to the original payment method and typically appear within 5–10 business days. To request one, see Customer Support.
8. Featured-partner listing rules
By listing with us you confirm that your business holds the licenses and insurance required for the work you advertise and that your listing information is accurate. The public list is ordered by our published rules (paying partners first, nearest the visitor first); we don’t guarantee any number of views, calls, or jobs. We may edit a listing for accuracy or decline or remove one that is inaccurate, draws credible complaints, or violates these terms. You grant us permission to display your business name, logo, and contact details on the Services for the life of the listing.
9. Using leads you receive
If you receive leads or customer contact information from us, you agree to:
- use it only to respond to that person’s service request;
- not resell, share, or add it to unrelated marketing lists;
- follow all laws that apply to contacting people, including the Telephone Consumer Protection Act, the CAN-SPAM Act, and Florida’s telemarketing laws, and honor any opt-out request immediately; and
- protect it with reasonable security and delete it when you no longer need it.
10. Your responsibilities for automated messaging
Where Rise sets up texting, calling, email, or AI-assisted intake for your business, you remain the sender of those messages. You are responsible for having the consent your contacts’ messages require, for the accuracy of the content you approve, and for telling us promptly about any opt-out or complaint you receive. We build opt-out handling into the systems we configure and will pause any workflow you ask us to.
11. Acceptable use
You agree to submit only accurate information about genuine service needs and not to misuse the Services — including submitting false requests or reviews, scraping, attempting to access accounts or data that aren’t yours, disrupting the platform, sending spam through it, or violating any law.
12. Intellectual property
The Services, including our software, design, text, and the Rise and RiseSWFL names and logos, belong to Rise or its licensors. You keep ownership of the content and data you provide us, and you give us permission to use it to provide the Services to you. Websites and materials we create for a client are licensed or assigned as stated in that client’s proposal or order.
13. Third-party services
The Services rely on third parties such as Stripe (payments), Google (maps and business ratings), and telephone and email carriers. Their own terms apply to your use of them, and we aren’t responsible for their availability or content.
14. Suspension and termination
We may suspend or end your access to the Services if you breach these terms, fail to pay, or use the Services in a way that could harm others or expose us to liability. Where practical we’ll give notice and a chance to fix the problem first. Sections that by their nature should survive — including payment obligations, lead-use rules, disclaimers, limits of liability, and indemnity — survive termination.
15. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any particular number of leads, calls, sales, rankings, or revenue.
16. Limitation of liability
To the fullest extent permitted by law, Rise is not liable for the acts or omissions of any service provider, or for indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim arose, or $100 if you paid us nothing. Some jurisdictions don’t allow these limits, so they may not fully apply to you.
17. Indemnity
If you use the Services for a business, you agree to defend and indemnify Rise against third-party claims arising from your services to customers, your messages to contacts, your use of leads, or your breach of these terms.
18. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally; most concerns are settled that way within 30 days. Any dispute that isn’t resolved will be decided in the state or federal courts located in Lee County, Florida, and you and we consent to their jurisdiction. Either party may bring a qualifying claim in small-claims court.
19. Changes to these terms
We may update these terms from time to time. We’ll post the new version here with a new date and, for material changes affecting paid customers, email you at least 30 days before they take effect. Continued use after the effective date means you accept the update.
